Our mobile application ("App") enables users, including employees, residents, and regular visitors, to recharge their monthly parking passes and avail of other automotive-related services. By using our services, you agree to the terms outlined below.
2. Scope of Services
ParkSmart provides a comprehensive suite of technology solutions for parking sites, including but not limited to:
Installation and operation of boom barriers, ANPR cameras, and Fastag deduction IoT systems.
A mobile application ("App") that allows users to:
Recharge monthly parking passes.
View parking transaction history and entry-exit logs.
Pay for short-term parking.
Access automotive-related services such as traffic challan payments.
Receive parking-related notifications and alerts.
Integration with third-party payment gateways to facilitate transactions.
ParkSmart is a technology service provider only and does not own, operate, manage, or control any parking facility. All parking-related policies, including but not limited to pricing, enforcement, and availability, are determined by the respective parking operators. ParkSmart provides a technology platform that facilitates the recharge of monthly parking passes, but it has no control over the pricing, issuance, or conditions of the passes, which are solely determined by the respective parking operators. for designated parking sites. We do not own, operate, manage, or control any parking facility. The issuance, management, and enforcement of parking passes are the sole responsibility of the respective parking operators.
3. Payment & Transaction Terms
Users may recharge their monthly parking passes through our App using the designated payment gateway.
The recharge amount is determined by the respective parking site operator and is subject to change.
All transactions are final and non-refundable, except in cases of failed transactions or duplicate payments. Refunds, if applicable, must be approved in writing by the respective parking operator. Once approved, refunds will be processed by the payment service provider after deducting any applicable non-refundable charges, such as convenience fees.
Users are responsible for entering accurate details while making a recharge. ParkSmart is not liable for incorrect information entered by users.
4. Liability Disclaimer
ParkSmart is a technology service provider only and assumes no responsibility for disputes arising from the use of its platform. By using our services, users acknowledge and accept that any risks related to parking operations, enforcement, or site conditions are solely their responsibility and must be addressed directly with the respective parking operator. ParkSmart is not liable for:
Vehicle damage, theft, or vandalism within the parking premises.
Unauthorized parking or violations of site-specific parking rules.
Operational issues related to parking equipment, including boom barriers, ANPR cameras, or Fastag deduction systems.
Parking availability, entry restrictions, or disputes over payment or parking fees.
Service outages, system downtime, or technical malfunctions affecting the App or payment processing.
Any loss or inconvenience resulting from incorrect vehicle or user information entered by users. ParkSmart is a technology service provider only and assumes no responsibility for disputes arising from the use of its platform. By using our services, users acknowledge and accept that any risks related to parking operations, enforcement, or site conditions are solely their responsibility and must be addressed directly with the respective parking operator.
Vehicle damage, theft, or vandalism within the parking premises.
Unauthorized parking or violations of site-specific parking rules.
Any operational or service-related issues at the parking site.
Parking availability, entry restrictions, or site-specific conditions. All such matters fall under the jurisdiction of the respective parking operators.
5. User Responsibilities
Users must provide accurate and up-to-date information while using the App.
Users must comply with all parking rules and regulations set by the parking operator.
Monthly passes and short-term parking transactions are non-transferable and must only be used for the registered vehicle.
Users are responsible for ensuring timely renewal of parking passes and compliance with parking terms.
Users must ensure their mobile device is compatible with and has access to the ParkSmart App to avail of services.
Users must comply with all parking rules and regulations set by the parking operator.
The monthly pass is non-transferable and must be used only for the registered vehicle.
Users are responsible for ensuring that their pass is valid and renewed on time.
6. Dispute Resolution & Customer Support
Any concerns or disputes regarding the use of parking passes, enforcement, or site conditions must be directed to the respective parking operator.
ParkSmart shall not mediate or intervene in parking-related disputes between users and operators.
7. Third-Party Payment Gateway
Payments for pass recharges are processed through a third-party payment gateway.
ParkSmart does not store or process payment information directly.
In case of failed or duplicate transactions, users must first contact the respective parking operator and obtain written confirmation if a refund is applicable. Once the operator provides written approval, users may then contact ParkSmart to initiate the refund process, which will be carried out through the payment service provider after deducting any applicable non-refundable charges, such as convenience fees.
8. Service Availability, Termination & Modifications
ParkSmart reserves the right to modify, suspend, or discontinue any of its services, including but not limited to monthly pass recharge, short-term parking payments, and other App functionalities, at any time without prior notice.
ParkSmart may suspend or terminate a user’s access to services in case of non-compliance with these Terms and Conditions, fraudulent transactions, or misuse of the platform.
Users acknowledge that service availability may be affected by factors beyond ParkSmart’s control, including third-party service provider disruptions, internet connectivity issues, or force majeure events.
ParkSmart reserves the right to modify, suspend, or discontinue the recharge service at any time without prior notice.
Users who violate these terms may have their access to the App revoked.
